These Terms of Use ("Terms") govern your access to and use of the Glimmer mobile application (the "App"), provided by Glimmer ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
1. License and Access
1.1 License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, solely for your personal, non-commercial use.
1.2 License Restrictions
You may not:
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse engineer, decompile, or attempt to extract the source code of the App
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices
- Use the App for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to our systems or networks
- Interfere with or disrupt the App's functionality or servers
- Use automated means to access the App without our express written permission
2. Account and Subscriptions
2.1 Free Version
The free version of the App provides limited access to features and content. Usage limitations may apply, including restrictions on daily content access and available feature sets.
2.2 Premium Subscription (Glimmer+)
Glimmer+ is an optional paid subscription that unlocks additional features, including:
- Unlimited access to favorites
- Full access to all focus areas and content
- Exclusive themes and customization options
- Advanced content export and sharing capabilities
2.3 Billing and Payment
Subscriptions are billed through your Apple App Store or Google Play Store account. Payment will be charged at the time of purchase confirmation. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
You may manage your subscription and turn off auto-renewal through your device's account settings. Cancellation takes effect at the end of the current billing period.
2.4 Refunds
All purchases are processed through the Apple App Store or Google Play Store and are subject to their respective refund policies. We do not have access to or control over app store billing and cannot process refunds directly. Please contact Apple or Google support for refund requests.
2.5 Free Trials
We may offer free trial periods for premium subscriptions. If you do not cancel before the trial period ends, you will be charged the applicable subscription fee. We reserve the right to modify or discontinue free trials at any time.
3. User Conduct and Responsibilities
3.1 Acceptable Use
You agree to use the App in compliance with all applicable laws, regulations, and these Terms. You are responsible for all activity that occurs under your account.
3.2 Prohibited Activities
You may not:
- Use the App in any manner that could harm, disable, or impair our services
- Transmit viruses, malware, or other harmful code
- Collect or harvest information from the App using automated means
- Impersonate any person or entity or misrepresent your affiliation
- Share your subscription access with unauthorized users
- Violate any applicable laws or regulations
4. Intellectual Property Rights
4.1 Our Property
The App, including all content, features, functionality, designs, graphics, text, audio, video, software, and other materials, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.
4.2 User-Generated Content
Content you create using our AI features remains yours for personal use. However, by using the App, you grant us a limited license to process and store your preferences and settings necessary to provide the services.
4.3 Trademarks
"Glimmer" and related marks are our trademarks. You may not use our trademarks without our prior written permission.
5. Third-Party Services and Links
The App may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk.
6. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
We do not warrant that the App will be uninterrupted, secure, or error-free, or that defects will be corrected. You use the App at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability to you for all claims arising out of or related to these Terms or the App shall not exceed the amount you paid us in the twelve months preceding the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Your violation of any applicable laws or regulations
9. Modifications to the App and Terms
9.1 App Changes
We reserve the right to modify, suspend, or discontinue the App or any features at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.
9.2 Terms Changes
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App or through other appropriate means. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.
10. Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.
You may terminate your use of the App at any time by deleting the App from your device and canceling any active subscriptions.
11. Governing Law and Dispute Resolution
11.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of your jurisdiction of residence, without regard to conflict of law principles.
11.2 Dispute Resolution
Any disputes arising out of or relating to these Terms or the App shall be resolved through good faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration or in the courts of your jurisdiction, as applicable.
12. General Provisions
12.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings.
12.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
12.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
12.4 Assignment
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.
